No. Parties can mediate without a lawyer but parties do have the option to hire a lawyer if they choose.
Does the mediator decide the outcome of the mediation?
No. The mediator is simply there to facilitate a line of communication between the parties.
Is the mediator a lawyer?
No. Although some lawyers do work as mediators, a mediator is not a lawyer and therefore, cannot offer legal advice.
What happens if we cannot come to an agreement during mediation?
The mediator will call an impasse and refer to the appropriate court so the dispute can be scheduled for a trial.
How much does mediation cost?
The cost of mediation typically starts at about $100.00 per hour per party.
How long does a mediation take?
Mediation sessions typically are blocked off for four (4) hours. However, the time can vary based upon the complexity of the mediation.
Can I take notes during mediation?
Parties are allowed to take notes during mediation to reference during discussions. However, due to the confidentiality of the mediation, no notes may be removed from the session.
Can I use any information from the mediation if I have to go to trial?
No. Information discussed during the mediation cannot be used beyond the mediation session, including for court trail.
If mediation is successful, how does a party receive/pay on the agreement?
If a mediation is successful, all parties will sign an agreement and the mediator will submit it to the court and all payment arrangements agreed upon will be established and monitored by the court.
